Copyright & DMCA Takedown Policy

Notice-and-takedown process with dual authenticated channels, strict verification, and binding online arbitration for counter-notices.

Effective 2 August 2026Version 1.0Notices legal@codexvert.com

1. Overview and Purpose

This policy governs copyright and trademark complaints for content hosted on Codexvert infrastructure. While the Digital Millennium Copyright Act is a United States statute, Codexvert applies an equivalent notice-and-takedown process under Indian law, including the Information Technology Act, 2000. This policy is incorporated into the Terms of Service.

2. Designated Agent

All notices must be sent to:

AddressAzamgarh, Uttar Pradesh, India

3. Filing a Takedown Notice – Dual Channel Model

Channel A – Authenticated Paymenter Ticket (Preferred, Lower Burden)

This channel is available to any complainant who files via an authenticated ticket in the Paymenter client area or via verified email with anti-spoof. In this channel, a URL is sufficient to identify infringing material. You are not required to provide internal Service ID, VPS ID, or server IP; Codexvert will perform internal mapping from IP and URL to the relevant service within 24 hours at no cost to complainant. The statutory 6-element notice still applies but Service ID is treated as optional. The timeline starts upon receipt.

Six elements required:

  1. Identification of copyrighted work.
  2. Identification of infringing material (URL sufficient in this channel; Service ID optional).
  3. Full contact details (name, address, email, phone).
  4. Good-faith belief statement.
  5. Perjury statement of accuracy and authority.
  6. Physical or electronic signature.

Channel B – Unauthenticated Notices (Discord, WhatsApp, Generic Email)

Notices received via unauthenticated supports such as Discord tickets, WhatsApp messages, or generic email must meet a stricter identification standard to prevent abuse and spoofing. In this channel, you must provide both the exact URL and, to the extent known, the Service ID, VPS ID, or server IP, plus the full six elements. Notices that are incomplete, obviously invalid, or fail the six-element test may be returned for completion, and the response timeline does not commence until a complete notice is received.

Why dual channels?Authenticated Paymenter channel reduces burden on rightsholders (URL-only) and allows provider-side mapping, preventing weaponization via "incomplete" returns. Unauthenticated channels remain strict to prevent spoofed takedowns.

4. Process and Timelines

StepTimeline
Acknowledge receiptWithin 24 hours
Review for validity (Channel A: provider maps ID; Channel B: check completeness)Within 24-48 hours
Act on valid notice (disable or remove)Within 48-72 hours from receipt (Channel A) or from complete notice (Channel B)
Notify affected customer with copy of notice and counter-notice instructionsWithin 24 hours of action

5. Counter-Notice and Online Dispute Resolution

If you believe material was removed by mistake or misidentification, you may file a counter-notice containing:

  1. Identification of removed material and prior location.
  2. Full contact details.
  3. Perjury statement that removal was due to mistake or misidentification.
  4. Consent to Online Dispute Resolution and acceptance of email service.
  5. Signature.

Binding Online Arbitration (ODR)

All counter-notice disputes are submitted to binding Online Dispute Resolution under the Indian Arbitration and Conciliation Act, 1996. Hearings are conducted via secure video conferencing, with a sole arbitrator seated in Azamgarh, Uttar Pradesh, India, but without requirement for physical travel. Service of process via email is accepted. Parties may mutually agree to a WIPO UDRP-style online process. This mechanism eliminates the burden of international travel while preserving due process for both parties. The arbitration award is final and enforceable under Indian law.

6. Restoration

Upon receipt of a valid counter-notice, we will restore material within 10 to 14 business days unless the claimant provides proof that they have filed a court action or commenced online arbitration seeking to restrain the activity.

7. Repeat Infringers and Preservation

  • 2 confirmed strikes = final written warning.
  • 3rd confirmed strike = termination of account and services.
  • Strike records are retained per preservation hierarchy defined in Terms: court/LE preservation 90-180 days pause deletion, Critical abuse minimum 90 days, otherwise per standard retention.
  • Reseller safe harbor: where reseller terminates offending end-client within 24 hours and preserves logs, strike applies to end-client only.

Built for the infrastructure behind your ideas.
